Terms of Service

These Terms of Service ("Terms") govern your access to and use of Subtext (the "Service"), operated by Subtext ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Subtext is a people intelligence platform that builds behavioral models of individuals in your professional environment. You provide observations and information about people you work with, and the Service applies behavioral analysis frameworks to generate insights about interpersonal dynamics, motivations, and communication patterns.
Subtext is not a substitute for professional advice. The behavioral models and insights generated by the Service are approximations based on the information you provide and are produced using AI. They are not psychological assessments, diagnoses, or professional evaluations. You should not rely on Subtext as your sole basis for making consequential decisions about people.
2. Eligibility
You must be at least 18 years old to use the Service. By using Subtext, you represent that you meet this requirement.
3. Your Account
You sign in using Google OAuth. You are responsible for maintaining the security of your Google account and for all activity that occurs under your Subtext account. Notify us immediately if you suspect unauthorized access.
4. Subscriptions and Payment
4.1 Billing
Subtext is offered as a paid subscription service. Payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis at the start of each billing cycle.
4.2 Price Changes
We may change subscription pricing with at least 30 days' notice. Price changes take effect at the start of your next billing cycle after the notice period.
4.3 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until then. We do not provide prorated refunds for partial billing periods.
4.4 Refunds
All fees are non-refundable except where required by applicable law. If you believe you have been charged in error, contact us within 14 days of the charge.
5. Your Content and Conduct
5.1 Ownership
You retain ownership of all observations, descriptions, and other content you provide to the Service ("Your Content"). By submitting content, you grant us a limited license to process, store, and display it solely to provide and improve the Service for you.
5.2 Responsibility for Your Content
You are solely responsible for the information you enter into Subtext about other people. You represent that:
- Your use of the Service complies with all applicable laws, including any workplace privacy policies or obligations that apply to you
- You will not use the Service to harass, stalk, discriminate against, or harm any individual
- You will not input content that is knowingly false with the intent to harm another person's reputation or standing
- You understand that behavioral models are AI-generated interpretations, not verified facts about the people they describe
5.3 Prohibited Uses
You may not:
- Use the Service to make employment, legal, or medical decisions about individuals
- Share, publish, or distribute behavioral models generated by the Service outside your personal use
- Reverse-engineer, scrape, or attempt to extract the underlying models, frameworks, or algorithms
- Use the Service for any purpose that violates applicable law
- Attempt to gain unauthorized access to the Service or its infrastructure
6. Intellectual Property
The Service, including its behavioral frameworks, signal taxonomy, algorithms, interface, and all associated intellectual property, is owned by us and protected by applicable law. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as a subscriber.
7. AI-Generated Output
Behavioral models and insights produced by the Service are generated using large language models and proprietary analytical frameworks. This output:
- May be inaccurate, incomplete, or reflect biases present in your input or in the underlying models
- Should not be treated as objective truth about any individual
- Is provided for informational and self-development purposes only
We disclaim all liability for decisions you make based on AI-generated output.
8. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that behavioral models will be accurate or complete.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, in no event will Subtext, its founders, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service, regardless of the theory of liability.
Our total cumulative liability for all claims arising out of or related to these Terms or the Service will not exceed the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Subtext and its founders, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, your violation of these Terms, or your violation of any rights of another person.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 5.2, 6, 7, 9, 10, 11, and 14 survive termination.
13. Changes to These Terms
We may modify these Terms at any time. If we make material changes, we will provide notice via email or through the Service at least 15 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
